SCOPE OF APPLICATION

JS CONSULTING, trading under the brand name LANGUAGE EXPERT (hereinafter “LANGUAGE EXPERT”), is a managed marketplace (hereinafter “Platform”) that connects Students and Teachers for online private lessons, under the domain languageexpert.eu (hereinafter “Website”) as a public information page and as a private page for customers and users where classes are registered and email notifications are sent to info@languageexpert.eu.

Use of the Website by Users implies acceptance of all the conditions included in this Legal Notice and in the Terms and Conditions, which may be modified or updated without prior notice.

DISCLAIMER OF WARRANTIES AND LIABILITY

LANGUAGE EXPERT reserves the right to interrupt access to the Website, as well as the provision of any or all of the content provided through it, at any time and without prior notice, whether for technical, security, control, maintenance, power supply failure, or any other justified reason. Users use the Website at their own risk, and at no time may they hold LANGUAGE EXPERT liable for the discontinuity or unavailability of its services.

LANGUAGE EXPERT shall not be liable in the event of service interruptions, delays, errors, malfunctions, and, in general, other inconveniences arising from causes beyond the control of LANGUAGE EXPERT, and/or due to malicious or negligent actions by Users and/or arising from causes of Force Majeure. Without prejudice to the provisions of the Civil Code, the concept of Force Majeure shall also be understood to include, for the purposes of these general conditions, all events beyond the control of LANGUAGE EXPERT, such as: failure of third parties, operators, or service companies; acts of government; lack of access to LANGUAGE EXPERT networks, acts or omissions by public authorities, those arising as a result of natural phenomena, power cuts, etc., and attacks by hackers, crackers, or other third parties on the security or integrity of the computer system. In any case, whatever the cause, LANGUAGE EXPERT shall not be liable for any direct or indirect damages, consequential damages, and/or loss of profits.

LANGUAGE EXPERT excludes any liability for damages of any kind that may be due to the lack of truthfulness, accuracy, completeness, and/or timeliness of the content transmitted, disseminated, stored, made available, or received, obtained, or accessed through the Website, nor for the content provided or offered by third parties or entities. LANGUAGE EXPERT will endeavor, as far as possible, to update and rectify any information hosted on the Website that does not meet the minimum guarantees of accuracy. However, it shall be exempt from liability for its failure to update or rectify it, as well as for the content and information provided therein. LANGUAGE EXPERT is not responsible for the content of the information collected on the Website, nor for any opinions, comments, assessments, or any other statements collected therein that are not issued directly by LANGUAGE EXPERT.

LANGUAGE EXPERT is not responsible for the use that Users make of the Website Content, their passwords, or any other material contained on the Website that may constitute a violation of any type of national or international regulation, intellectual or industrial property rights, or any other rights of third parties. Similarly, it is not responsible for any security errors that may arise from the use of outdated browser versions, or for the consequences that may arise from the malfunctioning of the browser, whether due to improper configuration, the presence of computer viruses, or any other cause beyond the control of LANGUAGE EXPERT.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All content on the Website, including but not limited to text, photographs, graphics, images, icons, technology, software, links, domains, trademarks, and other audiovisual or audio content, as well as its graphic design and source codes, are the exclusive property of LANGUAGE EXPERT and are subject to intellectual and industrial property rights protected by national and international legislation.

Any use of any of the elements subject to industrial and intellectual property rights for any purpose, especially commercial purposes, as well as their reproduction, distribution, public communication, distribution, modification, alteration, transformation, or decompilation, is strictly prohibited, unless expressly authorized in writing by the owner of these rights and without prejudice to the provisions of the Terms and Conditions.
